1. Scope and quotations
These terms describe the quotation and supply process for containers, modular units and accessories offered under the ABC containers name. The contracting seller and its full details must be identified in the quotation or order confirmation. A quote request is free of obligation and does not itself create an order or payment obligation. Individually agreed terms take priority where permitted by law.
2. Product information
Check the selected model, condition, dimensions, equipment and intended use before ordering. Images may show example units or optional equipment. New and used products can differ in appearance and condition. Any specific quality, certification, modification or suitability requirement must be confirmed in the written quotation. Nothing here removes responsibility for an agreed description or mandatory product standards.
3. Prices and payment
The written quotation sets out the product price, VAT treatment, delivery, unloading, installation and any other charges. Payment deadlines and any deposit must be agreed before the order is accepted. Website prices do not alone confirm a final delivered price. We will disclose additional charges before you commit to the contract.
4. Agreement and changes
A binding agreement requires acceptance of a quotation and confirmation of the agreed scope by the contracting seller. Delivery dates, customisation and services must be stated in that agreement. Changes require mutual agreement, including any effect on price or timing.
5. Delivery and site access
The quotation confirms the delivery location, transport arrangements and responsibility for unloading. Provide accurate site-access information and a suitable placement area. Tell us promptly about access restrictions or changes. Additional delivery or waiting charges require a contractual basis; they are not imposed automatically by these terms. Responsibility for permits and site preparation must be agreed for the specific project.
6. Inspection, defects and complaints
Inspect the delivered product and report visible damage or discrepancies promptly, ideally with photographs. This request does not shorten statutory rights. Contact info@abc-containers.de with the order reference and a description of the issue. Statutory conformity and defect rights remain applicable. Any additional commercial warranty is described separately.
7. Cancellation and consumer rights
Business-order cancellation is governed by the individual agreement and applicable law. Where a consumer concludes a qualifying distance contract, statutory withdrawal rights apply, generally for 14 days from receipt of goods. Exceptions can apply, including goods made to the customer's specifications or clearly personalised. Before concluding such an order, the seller must provide the applicable withdrawal instructions, model form and information about return arrangements and costs. You may communicate a withdrawal by an unequivocal statement to our email address. These terms do not restrict mandatory consumer rights.
8. Liability and applicable law
Liability and dispute handling follow the individual agreement and applicable law. These website terms do not exclude liability that cannot lawfully be excluded, or remove mandatory consumer protection. No exclusive court or choice of law is imposed here.
